1.1. This Privacy Policy informs you about the nature, scope, and purpose of the processing of personal data within our online offering and the websites, features, and content linked to it (hereinafter collectively referred to as the “online offering” or “website”). This privacy policy applies regardless of the domains, systems, platforms, and devices (e.g., computer or mobile phone) on which the website is accessed.
1.2. The terms used, such as “personal data” or its “processing,” refer to the definitions in Article 4 of the General Data Protection Regulation (GDPR).
1.3. We process master data (e.g., names and addresses, as well as customer contact information) and contractual data (e.g., services used, names of contact persons, payment information) in order to fulfill our contractual obligations and provide services in accordance with Article 6(1)(b) of the GDPR.
1.4. The personal data of users processed within the scope of this online offering includes master data (e.g., customer names and addresses), contractual data (e.g., services used, names of account managers, payment information), usage data (e.g., pages visited on our online offering, interest in our products), and content data (e.g., entries in the contact form).
1.5. The term “user” encompasses all categories of persons affected by data processing. These include our business partners, customers, interested parties, and other visitors to our website. Terms used, such as “user,” are to be understood as gender-neutral.
1.6. We process users’ personal data solely in compliance with applicable data protection regulations. This means that user data is processed only when there is a legal basis, in particular when data processing is necessary for the provision of our contractual services (e.g., order processing and inquiries) and online services, or when it is legally required, when users have given their consent, as well as based on our legitimate interests (i.e., interest in the analysis, optimization, and the economic operation and security of our online offering within the meaning of Art. 6(1)(f) of the GDPR), particularly in reach measurement, profiling for advertising and marketing purposes, as well as the collection of access data and the use of third-party services.
1.7. We note that the legal basis for consents is Article 6(1)(a) and Article 7 of the GDPR; the legal basis for processing to fulfill our services and execute contractual measures is Article 6(1)(b) of the GDPR; the legal basis for processing to fulfill our legal obligations is Article 6(1)(c) of the GDPR; and the legal basis for processing to safeguard our legitimate interests is Article 6(1)(f) of the GDPR.

2. How do we protect personal data?

2.1. We implement state-of-the-art organizational, contractual, and technical security measures to ensure compliance with data protection regulations and, thereby, to protect the data we process against accidental or intentional manipulation, loss, destruction, or access by unauthorized persons.
2.2. These security measures include, in particular, encrypted data transmission between your browser and our server, secure storage in protected areas, and hardware and software protection against unauthorized access by third parties or loss.
2.3. Trustpilot. We use the Trustpilot review portal, operated by TrustPilot A/S, Pilestraede 58, 5th floor, 1112 Copenhagen, Denmark. In order to continuously improve our service, we offer our customers the opportunity to rate us via this independent portal, without us being able to influence this in any way.
An invitation to leave a review is generated for each contract concluded with our group of companies. For this purpose, your first name, last name, email address, and a reference number (order number for unambiguous assignment) are transmitted to Trustpilot. Trustpilot does not use this data on its own behalf nor does it transmit it to third parties. You can leave a review of our company at https://de.trustpilot.com/evaluate/pfando.de. The review is verified based on the reference number (order number) via a specially generated link. Leaving a review is voluntary.
To leave a review or submit customer feedback, you must create and log in to a Trustpilot user profile. In addition to a review for the inviting company, reviews for any company can also be submitted on the Trustpilot review portal.
If a review is submitted by clicking the link included in the invitation, a user profile is automatically created on Trustpilot after entering personal data (name and email address for verification). By doing so, you consent to Trustpilot’s privacy policy and terms of service. These can be viewed on the Trustpilot website at http://de.legal.trustpilot.com/end-user-privacy-terms
By entering into a contract with us, you consent, in accordance with Art. 6(1)(a) of the GDPR, to the aforementioned transfer of the relevant data to TrustPilot and expressly agree to the automated sending of a review invitation from this platform.

Here you can see who your data is shared with

3.1. Data is disclosed to third parties only in accordance with legal provisions. We only transfer user data to third parties when necessary, for example, based on Article 6(1)(b) of the GDPR for contractual purposes or based on legitimate interests pursuant to Article 6(1)(f) of the GDPR for the economic and efficient operation of our business.
3.2. To the extent that we engage processors to provide our services, we implement appropriate legal provisions as well as corresponding technical and organizational measures to ensure the protection of personal data in accordance with applicable legal provisions.
3.3. If, within the scope of this privacy policy, content, tools, or other resources from other providers (hereinafter collectively referred to as “third-party providers”) are used and their headquarters are located in a third country, it must be assumed that a data transfer to the countries where the third-party providers are headquartered takes place. Third countries are those in which the GDPR does not apply directly, i.e., in principle, countries outside the EU or the European Economic Area. Data is transferred to third countries only if an adequate level of data protection exists, users have given their consent, or another legal basis applies.

4. What happens to your data when you contact us?

4.1. When you contact us (via contact form, phone, chat, or email), your data is processed to handle your contact request and its processing in accordance with Article 6(1)(b) of the GDPR.
4.2. User data may be stored in our customer relationship management system (“CRM System”) or in a comparable inquiry management system.

5. For your safety and ours, we collect access data and log files

5.1. Based on our legitimate interests within the meaning of Article 6(1)(f) of the GDPR, we collect data regarding each access to the server on which this service is hosted (so-called server log files). The access data includes the name of the website accessed, the file, the date and time of access, the amount of data transferred, confirmation of successful access, the browser type and version, the user’s operating system, the referring URL (the previously visited page), the IP address, and the requesting provider.
5.2. Information from the log files is stored for security reasons (e.g., to investigate cases of misuse or fraud) for a maximum of seven days and is subsequently deleted. Data that must be retained for evidentiary purposes is excluded from deletion until the relevant incident has been definitively clarified.
5.3. A backup of the web hosting database is performed every 4 weeks, overwriting the previous copy. This ensures that your data is not stored longer than necessary by our data processor.

6. To make your visit to our website even more enjoyable, we use cookies and web analytics

6.1. Cookies are pieces of information that our web server or third-party web servers transmit to users’ web browsers and that are stored there for later retrieval. Cookies can be small files or other types of information storage.
6.2. We use “session cookies,” which are stored only for the duration of your current visit to our online presence (for example, to enable navigation through your browser). A session cookie stores a randomly generated unique identification number, known as a session ID. In addition, a cookie contains information about its origin and storage period. These cookies cannot store any other data. Session cookies are deleted when you finish using our online service and, for example, log out or close your browser.
6.3. Our website offers language cookie functionality (WPML). These store the language in which you wish to view the website. If you navigate to one of the subpages, this cookie again specifies the language in which the subpage should be displayed to you.
6.4. Within the scope of this privacy policy, users are informed about the use of cookies in the context of pseudonymized reach measurement.
6.5. If users do not wish to have cookies stored on their computer, they are asked to deactivate the corresponding option in their browser’s system settings. Stored cookies can be deleted in the browser’s system settings. Disabling cookies may result in functional limitations of this online offering.
6.6. You can object to the use of cookies for reach measurement and advertising purposes via the Network Advertising Initiative’s opt-out page (http://optout.networkadvertising.org/) as well as on the U.S. website (http://www.aboutads.info/choices) or the European website (http://www.youronlinechoices.com/uk/your-ad-choices/).
6.7. You may modify your cookie consent at any time in our Cookie Policy.

7. To best serve you and tailor our offerings to your needs, we use Google Analytics

7.1. Based on our legitimate interests (i.e., our interest in the analysis, optimization, and commercial operation of our online offering within the meaning of Article 6(1)(f) of the GDPR), we use Google Analytics, a web analytics service provided by Google Inc. (“Google”). Google uses cookies. The information generated by the cookie regarding users’ use of the online offering is generally transmitted to a Google server in the U.S. and stored there.
7.2. Google is certified under the Privacy Shield Agreement and thus provides a guarantee of compliance with European data protection law (https://www.privacyshield.gov/participant?id=a2zt000000001L5AAI&status=Active).
7.3. Google will use this information on our behalf to evaluate users’ use of our online offering, to compile reports on activities within this online offering, and to provide us with other services related to the use of this online offering and Internet usage. Pseudonymized user profiles may be created from the processed data.
7.4. We use Google Analytics to display ads published through Google’s advertising services and those of its partners only to users who have also shown interest in our online offering or who exhibit certain characteristics (e.g., interests in specific topics or specific products based on the websites visited) that we transmit to Google (so-called “Remarketing” or “Google Analytics Audiences”). With the help of remarketing audiences, we also want to ensure that our ads match users’ potential interests and are not intrusive.
7.5. We use Google Analytics only with IP anonymization enabled. This means that users’ IP addresses are truncated by Google within the member states of the European Union or in other contracting states of the Agreement on the European Economic Area. Only in exceptional cases is the full IP address transmitted to a Google server in the U.S. and shortened there.
7.6. The IP address transmitted by the user’s browser will not be combined with other Google data. Users can prevent the storage of cookies by adjusting their browser settings accordingly; they can also prevent Google from collecting the data generated by the cookie and related to their use of the online service, as well as the processing of this data by Google, by downloading and installing the browser add-on available at the following link: http://tools.google.com/dlpage/gaoptout?hl=de.
7.7. You can find more information about Google’s use of data, as well as settings and opt-out options, on Google’s websites: https://www.google.com/intl/de/policies/privacy/partners (“How Google uses data when you use our partners’ websites or apps”), http://www.google.com/policies/technologies/ads (“Use of data for advertising purposes”), http://www.google.de/settings/ads (“Manage the information Google uses to show you ads”).

8. Always up to date with Google's remarketing and retargeting services

20. Let’s Chat on WhatsApp

20.1. To offer our customers and interested parties an additional means of communication, we provide contact via the WhatsApp messaging service. We use WhatsApp on the basis of our legitimate interests in fast and efficient communication and in meeting the needs of our contacts in relation to communication via messaging services in accordance with Art. 6(1)(f) of the GDPR.
20.2. If you wish to communicate with us via WhatsApp, please note the following information regarding the functioning, encryption, risks of WhatsApp, the use of metadata within the Facebook group of companies, and your options for objection.
You are not obliged to use WhatsApp and can contact us by alternative means, e.g., by telephone or email. Please use the contact details provided by us or those listed on our website.
20.3. WhatsApp (WhatsApp Inc., WhatsApp Legal, 1601 Willow Road, Menlo Park, California 94025, USA) is a US service, which means that data you send to us via WhatsApp may first be transmitted to WhatsApp in the US before being forwarded to us.
20.4. However, WhatsApp is certified under the Privacy Shield agreement and therefore guarantees compliance with European and Swiss data protection law (https://www.privacyshield.gov/participant?id=a2zt0000000TSnwAAG&status=Active).
20.5. WhatsApp also guarantees that the content of communications (i.e., the content of your message and any attached images) is end-to-end encrypted. This means that the content of messages is not accessible, even to WhatsApp. You should always use a current version of WhatsApp to ensure that the content of messages is encrypted.
20.6. However, we would like to inform you as our contact person, in particular as a customer or interested party, that although WhatsApp cannot see the content, it can know what and when the contact persons communicate with us, as well as technical information about the device used by the contact person and, depending on the device settings, also location information (so-called metadata). Except for encrypted content, it is possible to transfer data from the communication partners within the Facebook group of companies, in particular for the purpose of optimizing the respective services and for security purposes.
20.7. Furthermore, communication partners must assume, at least as long as they have not objected to this, that the data processed by WhatsApp may be used for marketing purposes or to display personalized advertising to users.
20.8. Further information on the purpose, type, and scope of WhatsApp's processing of your data, as well as your rights and settings options for protecting your privacy, can be found in WhatsApp's privacy policy: https://www.whatsapp.com/legal/.
20.9. You can object to communication with us via WhatsApp at any time. If you subscribe to messages (also known as "broadcasts") via WhatsApp, you can delete our corresponding phone number from your contacts and request that we delete your contact from our directory. In the case of individual inquiries or ongoing communications, you can also request that we discontinue communication via WhatsApp.
20.10. In the case of communication via WhatsApp, we delete WhatsApp messages as soon as we can assume that any user inquiries have been answered, no reference to a previous conversation is expected, and there are no legal retention obligations that prevent their deletion.
20.11. Deletion on the devices we use takes place within 30 days.
20.12. We also inform you that we do not pass on the contact details you have provided to us to WhatsApp without your consent (e.g., through contact initiated by us with you via WhatsApp).
20.13. Finally, we would like to inform you that, for security reasons, we reserve the right not to respond to inquiries via WhatsApp. This may be the case, for example, when certain contractual details require special confidentiality or when a response via the messaging service does not meet formal requirements. In such cases, we will refer you to more appropriate communication channels.

21. Snapchat

21.1 Our website uses the tracking tag of the social network Snapchat, operated by Snap Inc., 63 Market Street, Venice, CA 90291, USA. Snapchat is certified under the EU-U.S. Privacy Shield. Data processing by Snap Inc. is carried out within the framework of Snapchat's privacy policy. Information on data use can be found at: https://www.snap.com/de-DE/privacy/privacy-by-product/. Information about the Snapchat tag can be found in the Snapchat help area: https://businesshelp.snapchat.com/en-US/a/snap-pixel-about.
21.2 Purpose of data processing: The Snapchat pixel is used for analysis, optimization, and economic exploitation purposes.
With the help of the Snapchat pixel, Snap Inc. can identify visitors to our website as a target group for the display of advertisements. We use the Snapchat tag to show the Snapchat advertisements published by us only to those Snapchat users who have also shown interest in our online offering or who have certain characteristics that we transmit to Snapchat (Custom Audiences).
With the Snapchat tag, we also want to ensure that our Snapchat ads match the interests of users. In addition, we measure the effectiveness of Snapchat ads.
21.3 Legal basis for data processing: The legal basis for the processing of personal data through the use of the Snapchat pixel is Art. 6 (1) (f) GDPR, i.e., a legitimate interest on our part. Our legitimate interest lies specifically in the analysis, optimization, and economic exploitation of our website and our online offerings.
21.4 Possibility of objection and deletion / Opt-Out: You can object to the collection by the Snapchat pixel and the use of your data for the display of Snapchat ads. To configure which types of ads are shown to you within Snapchat, you can use the function available in the Snapchat app. You can also object to the use of cookies for reach measurement and advertising purposes via the Network Advertising Initiative's opt-out page (http://optout.networkadvertising.org/) and also on the US website (http://www.aboutads.info/choices) or the European website (http://www.youronlinechoices.com/uk/your-ad-choices/).

22. You'll love our newsletters

22.1. We would like to briefly inform you about the subscription, dispatch, and statistical evaluation process, as well as your rights of objection. By subscribing to our newsletter, you agree to receive it and to the procedure described.
22.2. Newsletter content: We send newsletters, emails, and other electronic notifications with the latest information about Pfando or our offers (hereinafter referred to as "newsletter") only with your consent or legal authorization. Insofar as the contents of the newsletter are specifically described in the context of the subscription, these shall be decisive for the consent of the users. Otherwise, our newsletters contain information about our products, offers, promotions, and our company.
22.3. Double opt-in and registration: Subscription to our newsletter is carried out using a procedure known as double opt-in. This means that after subscribing, you will receive an email asking you to confirm your subscription. This confirmation is necessary to prevent someone from subscribing with someone else's email address. Newsletter subscriptions are logged in order to be able to prove the subscription process in accordance with legal requirements. This includes storing the time of subscription and confirmation, as well as the IP address.
22.4. We use Newsletter2Go as our newsletter software. Your data is transmitted to Newsletter2Go GmbH. Newsletter2Go is a certified German provider, selected in accordance with the requirements of the GDPR and the German Federal Data Protection Act. Further information can be found at: https://www.newsletter2go.de/informationen-newsletter-empfaenger/
22.5. In addition, according to its own information, the mailing service provider may use this data in pseudonymized form, i.e., without assignment to a user, to optimize or improve its own services. However, the mailing service provider does not use the data of our newsletter subscribers to contact them directly or to pass it on to third parties.
22.6. Subscription data: To subscribe to the newsletter, simply enter your email address. However, in order to address you personally, we also ask you to provide us with your name.
22.7. Our newsletters contain a so-called "web beacon," i.e., a pixel-sized file that is retrieved from the mailing service provider's server when the newsletter is opened. During this retrieval, technical information is collected, such as information about your browser and system, as well as your IP address and the time of retrieval. This information is used for the technical improvement of the services based on technical data or target groups and their reading behavior based on access locations (which can be determined by the IP address) or access times. Statistical evaluations also include determining whether newsletters are opened, when they are opened, and which links are clicked. Although this information can be technically assigned to individual newsletter recipients, it is not our goal or that of the mailing service provider to observe individual users. Rather, the evaluations serve to recognize the reading habits of our users and to adapt our content to them or to send different content according to the interests of our users.
22.8. The use of the mailing service provider, the performance of statistical evaluations and analyses, and the recording of the subscription process are carried out on the basis of our legitimate interests pursuant to Art. 6 (1) (f) GDPR. Our interest lies in using a user-friendly and secure newsletter system that serves both our business interests and the expectations of our users.
22.9. Cancellation/revocation – You can cancel your subscription to our newsletter at any time, i.e., revoke your consent. This simultaneously terminates your consent to the mailing via the service provider and to statistical analysis. Unfortunately, it is not possible to separately revoke the sending by the service provider or the statistical analysis. You will find a link to unsubscribe from the newsletter at the end of each newsletter. If users have only subscribed to the newsletter and have unsubscribed, their personal data will be deleted.

IP addresses are shortened and stored in encrypted form (hash), so that it is not possible to identify households or individuals.
To prevent Piwik from collecting your data on our website, click on the following link: http://trck.spoteffects.net/analytics/index_siteid773.php?module=CoreAdminHome&action=optOut&language=de and uncheck the box.

In this context, your IP address, device information, and assigned tracking ID are processed and, if applicable, linked to data from our marketing campaigns. The installation of cookies and the processing of your personal data in this context is based on your consent in accordance with Art. 6 (1) (a) GDPR.

In this case, all personal data stored by Pfando in connection with your contact will be deleted.

The collection of data for the provision of the website and the storage of data in log files are essential for the operation of the website. Consequently, the user has no possibility of objection. However, you can exercise your right of objection through automated procedures using technical specifications, such as anonymizing your IP address through VPN providers.

For the collection of usage data for reach measurement purposes, the following section on the use of cookies by the provider for web analysis applies.

26. Integration of third-party services and content

26.1. We use cookies within our online offering on the basis of our legitimate interests (i.e., interest in the analysis, optimization, and economic operation of our online offering within the meaning of Art. 6 para. 1 lit. f) GDPR), we use content or services from third parties to integrate their content and services, such as videos or fonts (hereinafter collectively referred to as "content").
26.2. This always presupposes that the third-party providers of this content receive the IP address of the users, as without the IP address they would not be able to send the content to your browser. The IP address is therefore necessary for the presentation of this content. We endeavor to use only content whose respective providers use the IP address exclusively for the delivery of the content. Third parties may also use so-called pixel tags (invisible graphics, also known as "web beacons") for statistical or marketing purposes. 27. Retention and Deletion of Your Personal Data

27.1. The data stored by us will be deleted as soon as it is no longer required for its intended purpose and there are no legal retention obligations preventing its deletion. If user data is not deleted because it is required for other legally permissible purposes, its processing will be restricted. This means that the data will be blocked and not processed for other purposes. This applies, for example, to user data that must be retained for commercial or tax reasons.
27.2. In accordance with legal provisions, data is retained for 6 years in accordance with § 257, para. 1, of the HGB (commercial books, inventories, opening balance sheets, annual accounts, business letters, accounting vouchers, etc.) and for 10 years in accordance with § 147, para. 1, of the AO (books, records, status reports, accounting vouchers, business and commercial letters, documents relevant for taxation, etc.).
